Kaluwa Singh v. State Of U.P. And Others - WRIT - A No. 56630 of 2005 RD-AH 2039 (23 August 2005)
Hon'ble Amitava Lala,J.
Hon'ble Prakash Krishna,J.
It appears to this Court that the petitioner has challenged the suspension order dated 09.08.2005. We are of the view that order of suspension can not be regarded as punishment unless it is reflected from the order passed in connection thereto. The petitioner contended that he has positive case on the Government Order. We are not concerned to interfere with the same at this stage. Petitioner is at liberty to take such defence before the authority concerned. Thus we can not pass any order in the writ petition. The writ petition stands dismissed without imposing any costs. The inquiry, if started, will be expedited after affording opportunity of hearing preferably within a period of six months from the date of communication of this order.
