We have heard learned counsel for the appellant and learned A.G.A.
Admit.
Summon the record of the lower court.
Only the role of exhortation has been assigned to the appellant--Raja. The shot had allegedly been fired by non-appellant.
Under the circumstances, we order that the appellant, namely, Raja convicted and sentenced in Special Sessions Trial No.206 of 1997--State of U.P. Vs. Akram and another, be released on bail during pendency of the appeal on his executing a personal bond for a sum of Rs.25,000/- and furnishing two sureties each in the like amount to the satisfaction of the Special Judge(SC/ST Act), Agra.
Realisation of fine shall remain stayed during the pendency of the appeal.
The copy of bail bond and surety bonds shall be sent to the C.J.M., Agra within a week of their execution.
However, this order of bail shall not offer a ground of parity to the co-accused ( non-appellant).
