Sanjay Kumar Mishra And Another v. State Of U.P. Thru' S.S.P. Varanasi And Another - APPLICATION U/s 482 No. 12343 of 2005 RD-AH 2360 (5 September 2005)
Hon'ble M. K. Mittal, J.
Heard learned counsel for the applicants, learned A.G.A. and perused the record.
Application under Section 482 Cr.P.C. has been filed with the prayer to direct the lower Court to decide the bail applications of the applicants.
Learned counsel for the accused applicants has contended that the applicants have not been named in the F.I.R.. It appears that applicants moved an application for surrender before the Court below and on that application a report was submitted by the concerned Station Officer that the accused were wanted on 29.8.2005 in case crime No. 80 of 2005. But instead of appearing accused have come up before this court by filing this application. This is misuse of the process of the Court. Applicants must have appeared before the Court concerned.
In the circumstances application is devoid of any merits and is liable to be rejected.
Application filed under Section 482 Cr.P.C. is hereby rejected.
