Dr. Anamika Saxena v. State Of U.P. And Others - WRIT - A No. 59436 of 2005 [2005] RD-AH 2459 (7 September 2005)
|
Hon'ble Amitava Lala,J.
Hon'ble Prakash Krishna,J.
On the basis of prayer of the writ petition we can not pass any affirmative order because of the simple reason that the approval has not been given by any retrospective order from the date of her joining in the school. Secondly, the service is purely contractual in nature and the appointment was given by the Committee of Management on the fixed honorarium of Rs.5000/-. Therefore, second prayer for continuance of the service can not also be granted by this Court. However, it is entirely open for the Committee of management, if so desire, to do so, but we can not grant any relief. Accordingly the writ petition is dismissed. No order is passed as to costs.
