This petition has been brought for quashing the written report registered at Case Crime No. 272 of 2005, under sections 395, 506, 323, 332, 353, 412 I.P.C. read with Section 136(2) Lok Pratinidhi Adhiniyam with Section 7 Amended Criminal Act, police station Gulawati, district Bulandshahr. It is said that in the conduct of fair election obstruction was created by the petitioners and they looted the ballot boxes. Prima-facie the offences indicated above are made out against the petitioners.
Having regards to the facts and circumstances of the case we do not find any justified and justifiable ground for interference in the matter. Reliance may be placed in the cases of State of Haryana Vs. Ch. Bhajan Lal, AIR 1992 SC 604, Ajay Mitra Vs. State of U.P., AIR 2003 SC 1069 and Union of India Vs. Prakash P. Hinduja and another JT 2003(5) SC 300.
In the result the petition is dismissed.
