Heard and also perused the materials on the record.
This petition has been brought for quashing the written report registered at Case Crime No. 163 of 2005, under sections 420, 467, 468, 471 I.P.C. police station Jewar, district Gautam Budh Nagar. It is said that the petitioner in the capacity of Lekhpal was under obligation to give report for the purposes of issuance of caste certificate. He managed to have the report from a third person so as to play fraud upon the caste certificate issuing authority. Report was lodged by his immediate senior officer on the basis of the inquiry report. Prima-facie the offences indicated above is made out against the petitioner.
Having regards to the facts and circumstances of the case we do not find any justified and justifiable ground for interference in the matter. Reliance may be placed in the cases of State of Haryana Vs. Ch. Bhajan Lal, AIR 1992 SC 604, Ajay Mitra Vs. State of U.P., AIR 2003 SC 1069 and Union of India Vs. Prakash P. Hinduja and another JT 2003(5) SC 300.
In the result the petition is dismissed.
