Heard Sri Pradeep Kumar, learned counsel for the petitioner as well as Learned Standing Counsel for Respondent no.1 and Sri R.D.Khare for Respondent nos. 2 to 4. With the consent of the learned counsel for the parties this writ petition is being disposed of at this stage without calling for a counter affidavit.
The petitioner is aggrieved by an order dated 18.8.2005 passed by Respondent no.4 whereby he has been transferred from one division to another within the district of Bulandshahr. The contention of the petitioner is that the said order has been passed in violation of the own transfer policy of the respondent-Corporation as has been framed under the directions of the Apex Court dated 24.2.2005 issued in the case of Suresh Chandra Sharma vs. Chairman, U.P.S.E.B. (writ petition no.79 of 1997).
Having regard to the aforesaid submission this writ petition is disposed of with the direction that with regard to such grievance the petitioner may file a comprehensive representation before the Respondent no.5 who shall consider and decide the same, in accordance with law, after considering the case of the petitioner in terms of the transfer policy dated 30.5.2005. However, this order shall not be construed to mean that the operation of the impugned order is being stayed.
With the aforesaid observation this writ petition is finally disposed of. No order as to cost.
