Heard learned counsel for the petitioner as well as learned Standing Counsel appearing for respondents no. 1 and 2. Considering the nature of the order which is being passed, notices to respondent no. 3 are not being issued and this writ petition is being disposed of finally. In case if the said respondent no. 3 is so aggrieved, he shall be at liberty to file an application for modification, variation and/or recall of this order.
It is the case of the petitioner that he retired from the service of the respondent-Nagar Palika Parishad, district Jaunpur on 31.7.1999. It has been submitted that after his retirement the petitioner has been paid his post retiral dues only in part but his entire dues have yet not been paid despite the petitioner having filed several representations in this regard.
Considering the facts and circumstances of this case, this writ petition is finally disposed of with a direction that in case if, with regard to his grievances made in this writ petition, the petitioner files a fresh comprehensive representation before respondent no. 3, the Executive Officer, Nagar Palika Parishad, Shahganj, district Jaunpur alongwith a certified copy of this order, the same shall be considered and decided by the said respondent in accordance with law after giving opportunity of hearing to the petitioner expeditiously, preferably within a period of two months from the date of filing of the same.
With the aforesaid observations/directions, this writ petition is finally disposed of. No order as to costs.
