It has been stated that in the appeal of the petitioner pending against the municipal mutation order before the JSCC Allahabad is accompanied by an application for condonation of delay in filing the appeal. It has also been alleged by the petitioner that the respondent in the appeal has put in appearance. Therefore, the JSCC Allahabad will dispose of the application under section 5 of Limitation Act as expeditiously as possible without granting any undue and unduly long adjournment in the appeal. Thereafter the JSCC Allahabad will consider the injunction application no.297/2004 but before issuing such an injunction he will consider whether the JSCC would have power to pass such an order for immovable property.
With these observations, the writ petition is disposed of.
