Sukh Raj Chaudhari v. State Of U.P. And Others - WRIT - C No. 31168 of 2005 RD-AH 2665 (9 September 2005)
Writ petition No. 37168 of 2005
Hon'ble Yatindra Singh, J.
Hon'ble RS Rastogi, J.
1. This is a writ petition against the recovery for hulling charges.
2. We have heard counsel for petitioner and Standing counsel for the respondents. There seems some mistake in the recovery as the sum of two amounts mentioned in the notice dated 3.4.2003 is Rs. 13, 18, 738.50 and not the amount mentioned in the citation.
3. In the circumstances of the case, the petitioner may file a representation before respondent no. 3. In case the representation is filed, it may be decided by respondent no.3 by a speaking order, if possible, within one month from the date of receipt of the representation. The petitioner will file a certified copy of this order; necessary documents and a duly stamped self-addressed envelope along with his representation. Respondent no.3 after taking decision will communicate the same to the petitioner.
4. With these directions the writ petition is disposed of.
