The grievance of the petitioner is that even though he has filed the entire account to the Bank of Baroda, Meerut they are not giving statement of account in order to show as to whether the interest accrued on the debit has been entered or not. His further grievance is that in spite of payment of the entire amount the Bank is not returning the documents of title on which the property has been mortgaged.
We have heard Sri P.K.Srivastava learned counsel for the petitioner and Smt. Archana Singh, learned counsel for the respondent.
Taking into consideration the entire facts and circumstances of the case we dispose of the writ petition with the direction to the petitioner to file a complaint before the Banking Ombudsman appointed by the Reserve Bank of India for the purpose who shall take appropriate decision on the same in accordance with law. It is made clear that this Court has not adjudicated upon the claim of the petitioner on merits.
