The learned counsel for the petitioners submits that in similar circumstances a Division Bench of this Court has passed the stay order dated 21.7.2005 in writ petition no. 50701 of 2005.
The facts put forward by the petitioners are that the petitioners' fair price shop license was suspended along with show cause notice and the petitioners have filed their reply to the show cause notice, but the matter has not yet been decided by the respondent no. 3, who is the licensing authority. On these facts we fail to see how any stay order can be passed and therefore we refuse to believe that other writ petition was similar.
The best order that can be passed in these circumstances is requiring the respondent no. 3 to consider the explanation of the petitioner and to pass final order within one month of the date on which a certified copy of this order is presented before the respondent no. 3. Therefore, we pass that order.
The writ petition is disposed of with that order.
