Bhopal Singh Chaudhari v. State Of U.P. And Others - WRIT - A No. 60917 of 2005 RD-AH 2819 (14 September 2005)
Hon'ble A.P. Sahi,J.
Heard learned counsel for the petitioner, Sri Pradeep Pandey learned counsel for the respondent nos. 3 and 4 and learned Standing Counsel for the respondent nos. 1 and 2.
The petitioner has challenged the impugned order dated 22.8.2005 suspending him from the post of Headmaster of the institution in question. The contention on behalf of the petitioner is that the impugned order of suspension vaguely states that there are serious charges against him without specifying any of the charges in the impugned order. Learned counsel for the respondent nos. 3 and 4 produced before the Court a copy of the audit report which has been tendered on 31.8.2004 on the basis whereof it is alleged that the petitioner is to be charge sheeted for alleged financial irregularities.
Let the Respondent Nos. 3 and 4 submit the entire documents before the District Basic Education Officer, Ghaziabad - Respondent no.2, who shall consider the material on record and thereafter pass an appropriate order after giving an opportunity to the petitioner as expeditiously as possible preferably within a period of 6 weeks from the date of presentation of the certified copy of this order before him.
With the aforesaid direction, the writ petition is disposed of.
