The petitioner is permitted to implead respondent no. 5.
Issue notice. Notice on behalf of respondent nos. 1 to 3 and 5 has been accepted by Sri Govind Saran. Notice on behalf of respondent no. 4 has been accepted by standing counsel. They pray and are granted one month's to file counter affidavit and three weeks' thereafter for rejoinder affidavit.
Till further orders of the court, the recovery proceeding against the petitioner shall remain stayed provided the appellant deposits a sum of Rs. 1,000,00/- before respondent no. 5 within a period of three months from today. The petitioner shall be liable to pay provisional licence fees of Rs. 25,700/- for the year 2006-07. This amount may be deposited by the petitioner in the month of April, 2006. This fee will be liable to be enhanced by 7% every year and the enhanced licence fee may be deposited by the petitioner in the month of April of that financial year. In case of default the interim order would be deemed to be vacated. This arrangement is interim and will be subject to final decision in the writ petition.
