Yogendra Singh v. State Of U.P. And Another - WRIT - A No. 60683 of 2005 [2005] RD-AH 2865 (14 September 2005)
|
Hon'ble Amitava Lala, J.
Hon'ble Prakash Krishna, J.
The order of transfer has been challenged by the petitioner before this Court. But since the transfer has been made by virtue of recommendation of the Committee constituted by order of the Supreme Court dated 24.02.2005 passed in Public Interest Litigation No. 79 of 1997, we do not want to interfere with the same but we direct the petitioner to join on the transferred post and subject to his joining his representation will be considered by the appropriate authority upon giving fullest opportunity of hearing and by passing a reasoned order thereon within a period of two months from the date of his joining. For the purpose of effective adjudication a copy of the writ petition along with its annexures can be treated as part and parcel of the representation.
Accordingly, the writ petition stands disposed of.
However, no order is passed as to costs.
Dated: 14.09.2005.
