Heard learned counsel for the applicants, learned Addl. Government Advocate for the State and perused the record.
It is contended by the learned counsel for the applicants that no occurrence took place as alleged in the complaint. He has raised some factual aspects of the case which cannot be adjudicated at this stage particularly in a petition under Section 482 Cr.P.C. It is the trial court to enquire into the matter and record finding accordingly.
The application lacks merit and is dismissed accordingly.
However, in the event the applicants put in their appearance before the court below and make an application for their release on bail in complaint case no. 1362 of 2004, their bail application shall be disposed of as expeditiously as may be convenient in accordance with law and in case the learned Magistrate does not find fit case to release applicants no.7, 8 & 9 (the ladies) on bail, they shall be released on a personal bond of Rs.10,000/- each and they shall remain on the same personal bond till the final disposal of their bail application, if any, by the Court of Sessions.
