Supplementary affidavit filed be taken on record.
Heard learned counsel for the applicants, learned Addl. Government Advocate for the State and perused the record.
The contention of the learned counsel for the applicants is that the allegation of re-marriage of applicant 5 Laukush with applicant no.7 Rinki is false. No such marriage took place. He has drawn the attention of the Court towards paragraph-8 of the supplementary affidavit, a perusal of which would indicate that Laukush has not married Rinki. She is still unmarried.
Considering the facts and circumstances of the case, issue notice to opposite party no.2 returnable within four weeks.
List on 18th October, 2005.
Till then the proceeding in criminal case no.54 of 2004 pending in the court of III Addl. Civil Judge (J.D.) / Judicial Magistrate, Basti against the applicants no.1, 6 & 7 (Sunita - unmarried sister-in-law, Lorik and Rinki) shall remain stayed the the proceeding against the remaining accused shall go on.
