Heard Sri Shyam Sunder Mishra on behalf of the petitioner and Sri Ajay Kumar Srivastava on behalf of the respondent.
Counsel for the petitioner states that under the guidelines for recruitment of Ct/GD in C.R.P.F., as circulated by the Director General, CRPF, Kendriya Karyalay Parisar, Lodhi Road, ,New Delhi, an appeal has been provided for against the rejection of candidature on the ground of his being unfit. A power has been conferred upon the Appellate Authority to direct review medical examination.
In view of the aforesaid statement, the present writ petition is dismissed with liberty to petitioner to file an appeal before the Deputy Inspector General of CRPF in accordance with the aforesaid circular dated 13th September, 2002. If such an appeal is filed within two weeks from today along with certified copy of this order, the same shall be entertained by the Appellate Authority without raising any objection with regards to delay , if any, in filing of the appeal. The Appellate Authority shall consider the same in accordance with law and if required, in the facts and circumstances of the case, it may exercise such power as conferred in the said circular.
