The Assistant Commissioner (Food), Varanasi Division Varanasi vide order dated 2nd July, 2005 while allowing the appeal filed by respondent no.5 had directed the Sub Divisional Officer, Jakhania to redecide the matter after taking explanation from respondent no.5 and affording an opportunity of hearing. The order does not suffer from any legal infirmity.

The writ petition is misconceived which is hereby dismissed.
