Mansha Ram v. Shri Naveen Kumar Jain & Another - CIVIL REVISION No. 340 of 2005 RD-AH 3183 (20 September 2005)
Hon'ble Anjani Kumar, J.
The revisionist approached this Court by means of this revision under Section 25 of the Provincial Small Cause Courts Act against the order dated 12.8.2005 whereby the trial court has rejected his application No. 20-Ga which was filed seeking impleadment of Mansha Ram as one of the defendants. The landlord filed a suit for recovery of the arrears of rent and ejectment against Surjeet Singh who is the tenant in this suit. Mansha Ram filed an application got impleadment in the aforesaid suit.
The trial court held that Mansha Ram is neither necessary nor proper party and the suit filed by Mansha Ram has no concern with the present suit filed by plaintiff-respondent, Naveen Kumar Jain because in this suit the plaintiff has not claimed any declaration of his right or title
In this view of the matter, I do not find any error in the order passed by the trial court, so as to warrant any interference by this Court. This revision has no force and is dismissed.
