Radha Raman Tripathi & Others v. State Of U.P. & Others - WRIT - C No. 59876 of 2005 RD-AH 3192 (20 September 2005)
Hon. S. K. Singh, J.
Submission of the learned counsel for the petitioner is that in view of the interim order granted by this Court in writ petition no. 685 of 1994 which is still pending the issuance of fresh recovery certificate and recovery from the petitioners is clearly illegal. Be as it may, in view of the aforesaid the remedy of the petitioners is to move in that writ petition itself for appropriate relief and if there is something wrong on the part of the respondents in violation to the order of this Court then if law permits the recourse in the contempt side may also be taken but in no case filing of the second writ petition in respect to the recovery proceedings is to be permitted.
In view of the aforesaid, this Court refuses to grant any relief in this writ petition. Writ petition fails and is dismissed.
