Harish Chandra v. D.D.C. - WRIT - C No. 42476 of 2002 RD-AH 3270 (21 September 2005)
Court no. 40
Civil Misc. Writ Petition No. 42476 of 2002
Deputy Director Consolidation and others.............Respondents.
Hon. S.N.Srivastava, J.
Heard Sri Ayub Khan, learned counsel for the petitioner.
By the impugned order, the Deputy Director Consolidation Bulandshahr, on an objection filed by the present petitioner, dismissed the revision with liberty to file fresh revision before the Deputy Director Consolidation Aligarh/Mathura on the ground that the order under challenge was an order passed by the Settlement Officer Consolidation Aligarh. It transpires from the record that the contesting respondent has already filed revision which is pending before the Deputy Director Consolidation Aligarh/Mathura.
Considering the facts and circumstances of the case, I am of the view that the impugned order was rightly passed in accordance with law. As revision as already been filed , the Deputy Director consolidation Aligarh shall decide the same expeditiously.
In the result, the petition is dismissed. Interim order dated 4.10.2002 shall stand vacated.
