The Suit No. 357 of 1987 is pending after remand by the Appellate Court dated 30th March 2001. The remand order requires framing of issues in respect of a counter claim and obviously taking evidence on the new issues so framed.

In the circumstances, this writ petition is finally disposed of requiring the trial Court where the suit is pending to proceed with the disposal of the suit, unless there is any legal impediment, without granting undue or unduly long adjournments to the plaintiff in whose favour an injunction is said to be operative. The trial Court will keep in mind the provisions of Order 17 as well as Order 39 C.P.C.
