Submission is that against the loan amount taken on 26.6.2002 to the tune of Rs. 3 lakhs payable in nine years, petitioner has deposited an amount of Rs. 1,31,118.35 by now which includes the recent deposits on 30.3.2005 and 24.4.2005 of Rs. 25,000/- each, but petitioner has been arrested and is detained in the civil prison from 14.9.2005. Submission is that petitioner is 82 years old and in fact, in the facts no amount can be said to be in default.
Be as it may, on the facts it is directed that if petitioner deposits an amount of Rs. 10,000/- directly with the respondent bank, if the petitioner is under detention he will be released at once.
Sri S. N. Singh, learned Advocate who appears for the respondent bank may file response to the averments as made in the writ petition by the next date.
List this matter in the week commencing 24th October, 2005.
Counsel for the petitioner is directed to inform about this order in writing to the counsel for the respondent by 27.9.2005.
Let certified copy of this order be made available to the learned counsel for the parties on payment of usual charges today.
