Heard lSri Ranjeet Saxena and Sri R.N. Singh, learned Senior Counsel appearing for the contesting respondent.
This revision has been filed against the order dated 15th April 2005 whereby the trial court has rejected the application filed by the applicant for cross-examination of the deponent of the affidavit which has been filed in evidence. At the very outset Sri R.N. Singh, learned counsel for the contesting respondent, has agreed that this order deserves to be quashed in the interest of justice. Sri R.N. Singh has very frankly conceded that this order may be quashed. I have gone through the order and in my opinion also the order deserves to be quashed and is hereby quashed.
The order dated 15th April 2005 is quashed. The trial court is directed to fix a date within a week from the date of presentation of a certified copy of this order which both the parties have agreed to produce within a week from today. On such presentation of certified copy of the order the trial court is directed to fix a date for cross-examination of the parties concerned within a month and proceed to decide the suit.
With the aforesaid observations the revision is allowed.
