Indrajeet v. State Of U.P. Thru' Secy. & Others - WRIT - C No. 62480 of 2005 RD-AH 3564 (26 September 2005)
Civil Misc. W.P. No. 62480 of 2005
Hon'ble Sushil Harkauli, J.
Hon'ble Umeshwar Pandey, J.
It has been alleged by the petitioner that Shambhu Dayal got votes cast in his favour at gun point in the meeting held on 25.2.2005. The first complaint against such action was made by the petitioner after unreasonably long delay on 4.3.2005. The allegation of the petitioner has been disbelieved by the impugned order dated 29.6.2005. The findings recorded are findings of pure fact, which normally can not be interfered in the writ jurisdiction. Besides, due to the unreasonable delay in making the first complaint against such alleged voting on gun point, we are not inclined to interfere with the findings of fact.
The writ petition is dismissed as above.
