M/s Goyal Investments Thru' Partner v. State Of U.P. Thru' Secy. & Others - WRIT - C No. 62532 of 2005 RD-AH 3578 (26 September 2005)
Civil Misc. W.P. No. 62532 of 2005
Hon'ble Sushil Harkauli, J.
Hon'ble Umeshwar Pandey, J.
Heard learned counsel for the petitioner and Sri Atul Mehra for the respondents.
The petitioner's construction plan has been rejected by the Agra Development Authority. The petitioner has preferred an appeal under the provisions of U.P. Urban Planning and Development Act, 1973, which is said to be pending before the respondent No. 4, i.e. the Chairman, Agra Development Authority.
In view of these averments, the respondent No. 4 is directed to dispose of the appeal of the petitioner within one month of the date on which certified copy of this order is presented before the respondent No. 4.
Learned counsel for the petitioner has submitted that after rejecting the construction plan of the petitioner, the Development Authority has forwarded a proposal for acquiring that land, to the State Government. Learned counsel for the petitioner wants that this Court should pass an interim order restraining the State Government from acquiring the land merely on the ground that the appeal of the petitioner against the rejection of his construction plan is pending. The prayer is absolutely misconceived and is, therefore, rejected.
The writ petition is disposed of as above.
