Heard learned counsel for the applicant and Sri Ratan Singh, Advocate from the side of the complainant as well as learned A.G.A.
Co-accused was granted bail by this Court on the ground that the co-accused was given the role of conspiracy. Learned counsel for the complainant opposing the bail application states that the case of the present applicant is different because many notorious persons are alleged to have caused the injury to the deceased and the injured . The injured had received one gun shot injury and the deceased had received one injury. Who caused the the said injury is unknown.
I have perused the statement of the injured , namely ,Anil Kumar. He stated that all the notorious persons had caused the injuries to him and the deceased. Who caused the fatal below is not clear.
Considering the fact and circumstances of the case, the applicant is entitled to be released on bail.
Let the applicant Ram Prakash involved in case crime No. 43 of 2005 under section 147, 148, 149, 307, 302, 120-B IPC P.S. Kotwali Dehat, district Etah be released on bail subject to his executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of C.J.M. Etah.
