Submission is that in view of the statement of Branch Manager petitioner  is Matelu and not Matelu alias Bhojrat who is the loanee and, therefore, recovery against him has no justification.

Be as it may, this is a question of fact that whether petitioner has taken loan or not which can not be effectively decided by this court. In view of the aforesaid, keeping in mind the submission of the learned counsel for the petitioner about statement of Branch Manager,  Sri Verma, learned Advocate who represents the respondent bank is directed to obtain necessary instruction and make statement before this Court about the stand of the bank. Sri Verma may try to file affidavit also so that on that basis this Court may pass appropriate order.
