Heard learned counsel for the petitioners and the learned A.G.A. for the State.

Perused the allegations of F.I.R. and the material on record.

Learned counsel for the petitioners submitted that from the side of the petitioner a report was lodged at police station Pachaigaon under section 307 I.P.C. later on it was converted under Section 302 I.P.C. The impugned F.I.R. has been lodged as a counter blast on 27.8.2005. It is further contended that it is a no injury case.

Issue notice to respondent no. 3, who may file counter affidavit within three weeks.

Learned A.G.A. may also file counter affidavit within three weeks.

Considering the facts and circumstances of the case, till further orders, the arrest of petitioners in case crime no. 56 of 2005 under Sections 147,148,149,307,506 I.P.C. police Station Pachaigaon District Etawah shall remain stayed.
