The contention of the petitioner is that the Executive Officer, Cantonment Board, Kanpur vide letter dated 2nd September, 2005 had informed the petitioner that his bid for collecting tehbazari in respect of Faithfulganj Bazar has been accepted and he has been granted right to collect tehbazari for a period of one year from 2nd September,2005. However a public notice has been published in Hindi Daily "Dainik Jagran" on 30th September, 2005 informing that a public auction for collecting tehbazari would be held on 7th October, 2005. The submission is that the contract having been granted to the petitioner could not be put to auction afresh without any rhyme or reasons.
Notice on behalf of respondents no.1 and 2 has been accepted by the learned Standing Counsel. Let notices be issued to respondents no.3 and 4 fixing 14th November, 2005. List on 14th November, 2005. Counter affidavit be filed by 9th November, 2005. Rejoinder affidavit, if any, be filed on or before the date fixed.
As an interim measure, it is provided that the public auction, which is scheduled to be held on 7th October, 2005 may be held but the same shall not be finalized without the leave of the Court and the status quo as on the date when auction notice dated 30th September, 2005 was published shall be maintained.
