Argument is that on 30.6.2005 pursuant to the one time settlement scheme petitioner was required to deposit an amount of Rs. 52,250/- which he deposited on 8.7.2005 and thereafter petitioner was required to deposit an amount of Rs. 94,578/- on 29.9.2005 and the same amount on 29.12.2005.
Submission is that respondent bank has illegally deducted an amount of Rs. 4,750/- towards recovery charges in the first deposit and that is being apprehended in the remaining two deposits also.
Be as it may, if the contention of the petitioner is correct and petitioner was asked to deposit the amount on 29.9.2005 as indicated above vide annexure no. 5 to the writ petition then that amount of Rs. 94,578/- will be accepted by the respondent bank by 17.10.2005. It is made clear that no amount will be adjusted in the aforesaid deposit towards recovery charges. If the amount is deposited as indicated above then no amount will be recovered by taking any coercive process. In the event of default the amount may be recovered by taking any coercive process.
