We have heard the leared A.G.A. and have perused the impugned judgment of acquittal.
Admit and connect with Criminal Appeal No. 706 of 2000.
Issue bailable warrants against the accused respondents no.1, 2 and 3, namely, Shabir, Insha Allah and Mohd. Umar ensuring their presence before this Court on 21.11.2005. If they appear or are produced before the C.J.M., Ghaziabad, they shall be released on bail on each of them furnishing a personal bond of Rs. 25,000/- and two sureties each in the like amount to the satisfaction of the C.J.M., Ghaziabad.
A condition shall be provided in the bail bonds that the accused respondents shall appear before this Court on the date fixed (21.11.2005) and on further dates whenever required. After the accused respondents file the bail bonds, as stated above, the photocopies of the same shall be submitted to this Court by the C.J.M., Ghaziabad within two weeks from the date of their execution.
List on 21.11.2005 for appearance of the above accused respondents before this Court and for further appropriate orders.
