We have heard the learned counsel for the petitioner as well as the learned Standing Counsel.

It has been held by a Division Bench of this Court in  Nand Lal's case reported in 2002(1) AWC 781 that the Supreme Court has not placed complete prohibition on issue of new licenses for saw-mills.

By the impugned order dated 16.5.2005 the respondent no. 2 has rejected the request of the petitioner for registering his sawmill on the ground that there is complete ban by the Supreme Court.

In view of the above, we allow this writ petition and quash the impugned order dated 16.5.2005.  The matter will be examined fresh with reasons by the respondent no. 2 within six weeks.

The writ petition is disposed of as above.
