HIGH COURT OF JUDICATURE OF ALLAHABAD

HON. SHISHIR KUMAR, J.

The petitioner has approached this Court for issuing a writ of mandamus directing the respondents to issue registration forms for the students of Class 11th Science Group who are studying in the College for the Session 2004-05.

The contention of the petitioner is that the Secretary Madhyamik Shiksha Parishad, Allahabad has issued a letter dated 9.6.2005 stating therein that the institutions which are being registered, they may obtain the forms within 15 days from the date of registration and in case of summer vacation immediately within 15 days from the date of the opening of the College. The petitioner submits that the petitioner has submitted various applications to this effect but the respondents have not issued the forms. The first application was sent by the petitioner on 7.5.2005 and subsequently on 3.6.2005 and again on 30.8.2005 but inspite of the aforesaid applications the registration forms have not been issued up till date. The said action of the respondents as submitted by the petitoner cannot be appreciated.

I have heard the learned counsel for the petitioner and the standing counsel. Taking into facts and circumstances of the case as the petitioner has already submitted various applications in view of the directions issued by the Secretary Madhyamik Shiksha Parisahd dated 9.6.2005, the present writ petition is disposed of finally with direction to the respondent no.3 to consider the case of the petitioner regarding issuance of the registration forms within a period of two weeks from the date of production of certified copy of this order before him according to law.
