Ram Sakal Yadav v. District Magistrate & Others - WRIT - C No. 64711 of 2005 RD-AH 4138 (6 October 2005)
HON. SHISHIR KUMAR, J.
The petitoner has approached this Court for issuing a writ of mandamus directing the respondents not to compel the petitioner to deposit the firearm possessed by the petitioner through legal license. The petitoner submits that without any order in writing the respondents are forcing the petitoner to deposit the firm arm with the police authorities. The petitioner further submits that earlier in the year 2002 during the Assembly Election, the petitioner was directed to deposit his arm with the police authorities. The petitioner approached this Court by way of Writ Petition No. 3338 of 2002 in which an interim order was passed in favour of the petitioner and the said writ petition is still pending. Now if the authorities are compelling the petitioner to deposit the arm, the remedy to the petitioner is either to file a contempt petition or to file an application in the aforesaid writ petition.
In view of the aforesaid fact, the present writ petition is not maintainable which is hereby dismissed.
