Saghir Ahmad And Another v. State Of U.P. And Others - WRIT - A No. 65411 of 2005 RD-AH 4145 (6 October 2005)
Court no. 34
Civil Misc. Writ Petition no. 65411 of 2005
Saghir Ahmad and others vs. State of U.P. and others
Hon'ble Dr. B.S. Chauhan, J.
Hon'ble Bharati Sapru, J.
The writ petition has been filed seeking writ of certiorari quashing the impugned order dated 13.6.2005 passed by the respondent no. 3, by which the petitioners have been placed under suspension.
Heard learned counsel for the petitioners, learned standing counsel and have perused the record.
The contention of the petitioners is that they were not responsible for missing of wireless sets giving rise to the impugned suspension order. It is also contended that although the suspension order was passed against them more than three months ago, neither any enquiry has yet been initiated nor any charge sheet has been served against them so far.
Taking into consideration the entire facts and circumstances of the case, we are of the opinion that as the charge levelled against the petitioners is serious, we are not inclined to interfere in the matter and the writ petition is liable to be dismissed. However we direct the respondent no. 3 to take proper steps to initiate enquiry pursuant to the impugned suspension order against the petitioners forthwith and also to conclude the same preferably within a period of three months from the date of production of a certified copy of this order upon the said respondent by the petitioners.
Subject to the observation made above, the writ petition is disposed of.
