Sukhpal And Others v. Dy. Director Of Consolidation And Another - WRIT - B No. 44868 of 1998 RD-AH 4158 (6 October 2005)
WRIT PETITION No. 44868 of 98-B
Learned counsel for the petitioner states across the bar that number of writ petitions emanating from a common judgment dated 22nd Sept 1998 were allowed and the impugned orders were quashed by means of judgment of this Court dated 4.4.2002. He further stated that the present writ petition has also been filed assailing the said judgment dated 22nd Sept 1998 which has already been quashed vide Court's judgment dated 4.4.2002 and is apt to be disposed of in terms of the judgment dated 4.4.2002 aforestated.
Copy of judgment-dated 4.4.2002 has been placed before me, which I have gone through. Operative portion of judgment-dated 4.4.2002 is quoted below.
"The order dated 22.9.1998 passed by the respondent no. 1 is quashed and the matter is remanded to the District Deputy Director of Consolidation for deciding afresh in accordance with observations and the directions as indicated above."
Learned Standing counsel has no objection to the present petition being disposed of finally in terms of the judgment of the Court dated 4.4.2002.
Accordingly, writ petition is allowed in terms of the judgment-dated 4.4.2002 and the matter is relegated to the District Deputy Director Consolidation for decision afresh in the light of the observations made in the judgment-dated 4.4.2002.
