An application has been moved to recall the order dated 16.7.2003 passed by this Court by which the writ petition was dismissed for want of prosecution.
In the affidavit it has been stated that earlier counsel Sri R. S. Yadav has died and, therefore, case could not be attended and it was dismissed. It has been stated that as and when petitioner came to know about the order of this Court, application has been filed.
After considering the facts in respect to which there is no dispute, after hearing learned counsel for both sides, this Court is of the view that sufficient ground has been made out to recall the order of this Court. Delay in filing the application is condoned. Accordingly the order dated 16.7.2003 passed by this Court is recalled. Writ petition is restored to its original number.
In view of the recall of the order of this Court, it is hereby directed that status quo in respect to the nature as exists today shall be maintained by the parties.
