Budh Singh And Anr v. Smt. Kirpi And Ors - SECOND APPEAL DEFECTIVE No. 191 of 1998 RD-AH 4303 (18 October 2005)
Hon. Dilip Gupta, J.
This Appeal was presented for reporting on 27.4.1998 when it was reported by the Stamp Reporter that there was a deficiency of Rs. 717.50 towards the stamp to be affixed. The Appeal was presented on 4.7.1998 with an application for granting three weeks' time to make good the deficiency in court fees. The court fees was not made good in three weeks and on the other hand, an application was filed before this Court on 25.7.2002 that the Appeal be listed in the next cause list as the matter was very urgent. This Court on 13.8.2002 granted 15 days' time to the appellants to make good the deficiency in court fees. Even after a period of more than three years the deficiency in court fees has not been made good. Learned counsel for the appellants has not been able to satisfy the Court inspite of the repeated queries as to why the deficiency in court fees has not been made good till date and neither has any application been filed seeking further time to make good the deficiency in court fees.
The Appeal is, accordingly, dismissed for non-compliance of the order requiring the appellants to make good the deficiency in court fees.
