Claim of the petitioner, for regular appointment as Collection Amin in accordance with the U.P. Collection Amin Service Rules, 1974 as amended in the year, 1992, has been rejected under the impugned order dated 23rd November, 2004 with the remark that as and when selection for regular appointment as Collection Amin is initiated, the claim of the petitioner shall also be considered along with other eligible candidates.
In the opinion of the Court, the order passed by the District Magistrate to that extent does not call for any interference.
However, seasonal work shall be offered in accordance with the seniority of the Seasonal Collection Amins working in the district. Therefore, it is provided that the petitioner may make a detailed representation with regards to his claim, for being offered seasonal work, before the District Magistrate, Azamgarh within two weeks from today along with certified copy of this order. The District Magistrate in turn shall ensure that seasonal work is offered to the Seasonal Collection Amins strictly in accordance with the seniority maintained for the said purpose and shall pass orders on the representation accordingly.
Writ petition stands disposed of finally.
