Heard learned counsel for the applicants, learned AGA for the State and perused the record.
It is contended by the learned counsel for the applicants that the arrest of the applicants was stayed by this Hon'ble Court during the course of investigation. The charge-sheet was submitted, but no service of notice was effected upon the applicants to enable them to put in their appearance and non-bailable warrant has been issued against them. His contention is that the order issuing non-bailable warrant be stayed for a reasonable period so as to enable the applicants to put in their appearance before the court concerned.
Considering the facts and circumstances of the case, but without expressing any opinion on the merit of the case, the order dated 25.6.2005 passed by the court below issuing non-bailable warrant against the applicants shall remain stayed for a period of 10 days from today provided the applicants put in their appearance before the court concerned within the period indicated above and in case they make application for their release on bail in case crime no. 52 of 2003, their bail application shall be disposed of as expeditiously as may be convenient in accordance with law.
With these observations, the application stands disposed of accordingly.
