Applicant, Raju Thakur, has applied for bail in case crime no. 131 of 2005 under sections 25/27, Arms Act police station Bharthana district Etawah.
Heard learned counsel for the applicant and learned A.G.A. for the State and perused the papers on record.
As per the prosecution case the applicant had fired at a police party on 23.7.2005 at 4.45 A.M. and he was arrested on the spot. One country made pistol , two live cartridges and one boy Shivam aged about 14-15 years were recovered from his possession.
The learned counsel for the applicant submitted that it is a case of no injury and since the offence is triable by Magistrate, the applicant should be granted bail.
Without expressing any opinion on the merits of the case, I am of the view that the applicant deserves to be bailed out in this case.
Let the applicant, Raju Thakur, be released on bail in the aforesaid case on his executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of the court concerned.
