Heard learned counsel for petitioners and learned counsel for caveator.
Petitioners are allottees of Plot No. 79 area 1 Bigha 5 Biswas, new plot no. 305.
From perusal of material on record and the order of Deputy Director of Consolidation it is clear that petitioners are not affected parties by impugned order. Petitioners' land was not taken out and his chak is not affected by order of Deputy Director of Consolidation by which entire shortage of valuation in the chak of Opposite Party was compensated from the bachat land of Gaon Sabha. As petitioners' chak is not disturbed by impugned order, they are not aggrieved parties. Writ Petition therefore is not maintainable.
Writ Petition is dismissed.
