Rajesh Kumar Verma v. Adhyaksh U.P. Power Corporation Ltd. & Others - WRIT - C No. 52327 of 2004 RD-AH 490 (22 February 2005)
Writ Petition No. 52327 of 2004
HON'BLE YATINDRA SINGH, J.
HON'BLE R.K. RASTOGI, J.
1. This is a writ petition for a direction to respondent to connect the electricity line of the petitioner and to quash the assessment of electricity bill.
2. We have heard counsel for petitioner and Sri WH Khan, counsel for the respondents. This court has granted an interim order on 14.12.2004 on deposit of certain amount of money. The order indicates that amount has been deposited and petitioner states that electricity has already been connected. The only question is regarding the disputed amount of the bill.
3. In the circumstances of the case, the petitioner may file his objection before respondent no. 1 against the assessment of his bill within three weeks. Thereafter respondent no.1 may expeditiously decide his objection by a speaking order, if possible, within three months from the date of receipt of the objection. The petitioner will file a certified copy of this order; necessary documents and a duly stamped self-addressed envelope along with his objection. Respondent no.1 after taking decision will communicate the same to the petitioner. Needless to add as there is already an interim order by this court, till the objection of the petitioner is decided his electricity will not be disconnected. In case the petitioner does not file his objection within three weeks, then it will be open to respondent to realise the remaining amount.
4. With these directions the writ petition is disposed of.
