An application for interim injunction in a Civil Suit instituted by the petitioner is pending since July 2005. No ex parte interim injunction has been granted.
Next date is fixed for 14.11.2005.
Having regard to this averments of the petition we direct the trial court to consider whether any interim protection should be granted to the plaintiff pending disposal of the interim injunction application or not. This will be considered by the trial court by a reasoned order which will also include findings regarding service and deemed service of summons upon the defendant.
It will make clear that by passing the order we have not examined the claim of the petitioner on merit and the trial court will free to record its own finding.
Writ petition is disposed off.
