Heard learned counsel for the appellants and Learned A.G.A.
The appeal be admitted.
Learned counsel for the appellants submits that the appellants were on bail during the trial and are not said to have misused it at any point of time during that period. The deceased had received only fatal injury and the other injuries were on non vital parts. The other two injured in this case have received simple injuries.
It appears to be a fit case for release on bail.
Let the appellants namely Itwari Lal, Sita Ram, Tej Ram and Dodram, involved in S.T. Nos. 389 of 1999 and 388 of 1999, under Sections 304, 323, 324, I.P.C., 4/25 Arms Act, Police Station Bilsanda, District Pilibhit, be released on bail subject to their furnishing a personal bond with two sureties each in the like amount to the satisfaction of the trial court concerned. The realisation of fine to the extent of ½ shall remain stayed.
