1. The petitioner had filed an application for granting him permit for excavation of sand. According to the petitioner this application was allowed on 18.11.1996 and he was required to deposit 1/4th of the royalty. The case of the petitioner further is that he could not deposit 1/4th of the amount and thereafter he filed applications on 29.1.1997 and 1.3.1997 to cancel the permit granted to him. However, the recovery for the entire period has been issued against him. Hence the present writ petition.
2. We have heard counsel for petitioner and standing counsel for the respondents.
3. In the circumstances of the case, the petitioner may file representation before respondent no. 2. In case any such representation is filed, it may be decided by respondent no. 2 by a speaking order, if possible, within three-months from the date of receipt of the representation. The petitioner will file certified copy of this order; other necessary documents and a duly stamped self-addressed envelope along with the representation. Respondent no. 2 after taking decision will communicate the same to the petitioner.
4. With these observations the writ petition is disposed of.
