The counsel for the petitioner submits that this is a recovery against cash credit taken by the petitioner no.1 for which petitioner no. 2 was a guarantor.
Notices on behalf of respondents no. 1 3 and 4 have been accepted by the Standing Counsel. Notice on behalf of the respondent no.2 has been accepted by Sri Satish Chaturvedi. They pray for and are granted a month's time for filing counter affidavit. Rejoinder affidavit may be filed within three weeks thereafter
List this petition for admission thereafter.
Till further orders of the Court, recovery proceedings shall remain stayed, provided the petitioner no.1 deposits the disputed amount in six equal quarterly instalments before respondent no.2. The first instalment shall be deposited before the end of 31.1.2006 and the subsequent instalments may be deposited after the interval of every three months In case the deposits are not made in time, it shall be open to the respondents to start recovery proceedings.
