Two suits instituted by the petitioner one is of 2002 and second of 2005. In the subsequent suit an application for interim application is pending.
Having regard to the over all facts and circumstances of the case we decline to issue any direction to the trial court to permit the petitioner to make application before the trial court for considering the application of the petitioner for interim injunction or for granting of interim protection till the disposal of the application for interim injunction. If such an application is moved by the petitioner, the trial court will consider the same by reasoned order having regard to the situation of the service of summons, the nature of litigation in both the suits and all other relevant facts without granting undue and unduly longer adjournment.
The writ petition is disposed off.
